Zhichong Recharge Platform Service Agreement

[Preamble and Introduction]Welcome to the Zhichong Recharge Platform Service! The "Zhichong Recharge Platform Service Agreement" (hereinafter referred to as "this Agreement") is concluded between you and Zhichong, and this Agreement has contractual effect. To use the services of the Zhichong Recharge Platform, you should read and comply with this Agreement. Please carefully read and fully understand the content of each clause, especially those that exempt or limit our liability, jurisdiction and applicable law clauses, and separate agreements for activating or using specific services.
I. [Scope of the Agreement]1.1 This Agreement is an agreement between you and Zhichong regarding your use of the Zhichong Recharge Platform services. "Zhichong" refers to Zhichong Company and its operationally related entities that may be involved in providing related services. "User" refers to the person using Zhichong-related services, hereinafter referred to more often as "you" in this Agreement.1.2 The services under this Agreement refer to the Zhichong Recharge Platform services, specifically the electric vehicle charging service platform provided to users through the internet (including mobile internet) by Zhichong, including but not limited to charging station search, charging pile navigation, scan-to-charge, online payment, recharge, and other functions and services.
II. [Account and Password Security]2.1 You may need to register an account or bind a mobile phone number/WeChat ID when using Zhichong's services. For specific rules regarding your use of this account, please comply with the relevant separate agreements.2.2 Zhichong specifically reminds you to properly safeguard your account and password. After use, you should log out securely. Any losses resulting from stolen accounts or compromised passwords due to your improper safekeeping shall be borne by you.2.3 You shall bear full responsibility for all activities conducted using this account, and you agree that: Zhichong shall not bear any liability for losses caused by account or password disclosure.
III. [User Personal Information Protection]3.1 Protecting user personal information is a fundamental principle of Zhichong. In the course of using this service, you may need to fill in or submit some necessary personal information, including but not limited to mobile phone number, location information, vehicle information, etc.3.2 Zhichong will employ various security technologies and procedures to establish comprehensive management systems to protect your personal information, preventing its improper use or unauthorized access.3.3 For detailed personal information protection policies, please refer to the "Zhichong Privacy Policy".
IV. [User Conduct Standards]4.1 You shall comply with laws and regulations when using this service and shall not use this service to engage in illegal or non-compliant activities, including but not limited to: publishing illegal information, infringing upon the legitimate rights and interests of others, interfering with the normal operation of systems, etc.4.2 You shall not interfere with or disrupt this service or the servers and networks connected to this service by any means, nor engage in any behavior that may cause damage to the Zhichong service platform.4.3 If you violate the above agreements, Zhichong has the right to take measures such as suspending or terminating services, deleting illegal information, and reporting to relevant authorities. The consequences arising therefrom shall be borne by you.
V. [Charging Service Rules]5.1 When using charging services through this platform, you shall comply with the management regulations of the charging station site and correctly use charging equipment according to operating procedures.5.2 Charging fees shall be implemented according to the fee standards published at the charging station. This platform will truthfully display charging fee information. The actual deducted amount shall be based on the system settlement after charging is completed.5.3 If charging services cannot be provided normally due to charging equipment failure, abnormal power supply, or other reasons, Zhichong will assist you in communicating with the charging station operator for resolution.
VI. [Recharge Service Rules]6.1 You may recharge your account through this platform. The recharged amount will be deposited into your platform account balance and can be used to pay for charging fees.6.2 Once the recharged amount is credited to your account, it is in principle non-refundable. If you request a refund, you may contact customer service for processing, but we reserve the right to charge reasonable handling fees based on actual circumstances.6.3 Any losses caused by recharge errors due to your own reasons (such as recharging to the wrong account) shall be borne by you.
VII. [Intellectual Property Statement]7.1 The software, interface design, icons, text, images, and other intellectual property used on this platform belong to Zhichong or its affiliated companies. Without permission, you may not copy, modify, or disseminate the above content by any means.
VIII. [Disclaimer]8.1 Zhichong only provides a technical service platform for users and does not directly participate in the specific operation of charging services. The quality, safety, and other issues of charging services shall be the responsibility of the charging station operator.8.2 Zhichong shall not be liable for service interruptions, data loss, or other losses caused by force majeure, system maintenance, network failures, or other reasons.8.3 Zhichong shall not be liable for losses caused by improper user operation, equipment failure, third-party services, or other reasons.
IX. [Modification and Termination of Agreement]9.1 Zhichong has the right to modify the content of this Agreement as needed. The modified agreement shall take effect upon publication. If you continue to use this service, it shall be deemed that you accept the modified agreement.9.2 If you do not agree with the modified agreement, you should immediately stop using this service. If you continue to use this service, it shall be deemed that you have accepted the modified agreement.9.3 Zhichong has the right to terminate this service when necessary and will notify users as far in advance as possible before terminating the service.
X. [Applicable Law and Jurisdiction]10.1 The conclusion, execution, and interpretation of this Agreement shall be governed by the laws of the People's Republic of China.10.2 If any dispute arises between the parties regarding the content of this Agreement or its execution, it shall be resolved through friendly negotiation. If negotiation fails, either party may file a lawsuit with the competent people's court in the location of Zhichong.
XI. [Miscellaneous]11.1 The headings of all clauses in this Agreement are for reading convenience only and have no actual meaning in themselves, nor shall they serve as a basis for interpreting the meaning of this Agreement.11.2 If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain valid and binding.
